Petitioners seek bail in a case registered for the offences punishable under Sections 323, 341, 342, 307, 379, 504 and 506/34 of the Indian Penal Code.

Petitioner no. 1 Prithvi Mandal allegedly caused injury with Dabiya at the head of Sunil Mandal. Petitioner no. 2 Naresh Mandal caused injury to Popal Mandal with Dabiya at the head. Both are in custody since 10.12.2018. Investigation of the case is complete. The Doctor found injury on Popal Mandal caused by hard blunt substance, grievous in nature.

Learned counsel for the informant opposed the prayer for bail.

No.17062 of 2019(2) dt.16-04-2019 2/2 Considering the nature of allegation which does not contain any allegation of repetition of blow as well as considering the period already undergone and completion of investigation, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bihariganj Police Station Case No. 163 of 2017, subject to the condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
