JUSTICE MADHURESH PRASAD ORAL ORDER 24-11-2022 The petitioner has approached this Court with a grievance regarding non-consideration of his claim for compassionate appointment. It is his case that his father died in harness on 31.01.2016 while he was working in Grade III post in the Nagar Parishad, Samastipur. The application (Annexure4) is dated 07.08.2017. The learned counsel for the respondent-Nagar Parishad has appeared and has submitted that whether the petitioner would be entitled to compassionate appointment or not, is an issue which has to be considered with reference to the nature of his service.

Whatever will be the decision is yet to be taken by the respondents themselves, since the application is still pending. This Court would only add that the decision has to be in the light of the Government Guidelines applicable in the matter, by assigning reasons by way of speaking order and in accordance with law, and expeditiously within eight weeks from the date of receipt/production of a copy of this order.
