The petitioner seeks bail in Civil Line P.S. Case No. 492 of 2018, instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act, 2016. It is alleged in the written report that informant during patrolling duty received information that some illicit liquor has been unloaded from the tempo bearing registration No. BR02AA-4930. The informant along with Police party reached the place of occurrence and arrested co-accused Vikash Kumar. Vikash Kumar in his confessional statement took the name of this petitioner before the Police.
Counsel for the petitioner submits that there is no
Patna High Court CR. MISC. No.18802 of 2019(2) dt.28-03-2019 2/2 recovery of any illicit liquor from possession of the petitioner. Petitioner is in custody since 13.2.2019 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Gaya, in connection with Civil Line P.S. Case No. 492 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
