JUSTICE BIRENDRA KUMAR ORAL ORDER 07-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Madhubani (Town) P.S. Case No. 75 of 2016 registered for the offence punishable under Sections-406, 420, 467, 468, 471/34 of the Indian Penal Code. According to FIR, the petitioner was employee of the informant. The report of the Superintendent of Police, as called for in pursuance of order dated 17-01-2018, would reveal that the petitioner was neither sub dealer nor employee of the informant. The petitioner is said to have no criminal antecedent and he is in custody since 17-092017. Considering the nature of allegation and the aforesaid facts, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like

Patna High Court Cr.Misc. No.60112 of 2017 (4) dt.07-02-2018 amount each to the satisfaction of the learned Court below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which, the court below shall be at liberty to cancel the bail bond of the petitioner.
