The petitioner apprehends his arrest in Ladania P. S. Case No. 134/2013 (G.R. No. 2799/2013) registered for offences punishable under Sections 379/411 of the Indian Penal Code. The prosecution case is that on 16.11.2013, the informant, Krishnadeo Nayak, had parked his Splender Pro motorcycle bearing No. BR32E 9184 in front of his medicine shop at Mirzapur Chowk, on which day, there was a meeting of Rashtriya Janata Dal as such there was a huge crowd at the Chowk. At 5 P.M. the informant did not see his motorcycle and tried to search but could not find it and was confident that unknown thief has stolen his motorcycle.
Patna High Court Cr.Misc. No.36792 of 2015 (2) dt.09-09-2015 2/2 Learned counsel for the petitioner has submitted that the petitioner is not named in the F.I.R. and the name of the petitioner surfaced on the confessional statement of co-accused Anil Kumar Ram.
Considering the facts and circumstances, in case of arrest or surrender within a period of six weeks from today the above named petitioner namely, Sanjiv Kumar will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Ladania P.S.Case No. 134/2013, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure (Nilu Agrawal, J) Sudha/- U T
