08-07-2020 Heard learned counsel for the parties through video conferencing.

This relates to grant of bail in Sessions Trial No. 80 of 2018, arising out of Pakri Dayal P.S. Case No. 17 of 2017, registered for the offence under Sections 387/120(B) of the Indian Penal Code.

It is submitted on behalf of petitioner that petitioner is not named in the F.I.R. The name of petitioner has come on the basis of confessional statement of co-accused Mrityunjai Thakur. Nothing has been recovered from conscious possession of petitioner. With regard to criminal antecedent is concerned, the petitioner was earlier arrested in Motihari Town P.S. Case No. 544 of 2014 and thereafter, the police remanded him in other cases, as mentioned in paragraph - 3 of the petition. Some

Patna High Court CR. MISC. No.18717 of 2020(3) dt.08-07-2020 2/2 of the co-accused have already been granted bail by this Court, vide Annexures 2, 3 and 4 respectively.

However, learned A.P.P. for the State has vehemently opposed the prayer for bail and submitted that petitioner has got criminal antecedent, allegation is serious and in course of trial, four witnesses have already been examined by the prosecution. Considering the nature and gravity of the case and material available on record as also the fact that petitioner has got criminal antecedent, I am not inclined to grant him bail. Accordingly, the bail application stands dismissed. (Prabhat Kumar Singh, J.) anay U T
