JUSTICE ARUN KUMAR ORAL ORDER 10-01-2018 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner, already in custody, seeks bail in connection with Ram Krishna Nagar P.S. Case No.210 of 2017, registered under Section 414 of the Indian Penal Code.
Allegation against the petitioner is that one master key of motorcycle was recovered from his possession and alleged being a member of the gang involved in motorcycle theft and some stolen motorcycles were recovered from possession of other co-accused.
Learned counsel for the petitioner submits that there is no recovery of any motorcycle from possession of the petitioner, except the disclosure of the name of the petitioner in confessional statement of one Ritik Kumar, there is no other material and two
Patna High Court Cr.Misc. No.62490 of 2017 (2) dt.10-01-2018 2 /2 other co-accused Sanjay Kumar @ Sanjoy Paswan and Roshan Kumar whose names also transpired in the confessional statement of Ritik Kumar have been granted bail by a coordinate Bench of this Court by orders dated 18.10.2017 and 09.11.2017, passed in Cr. Misc. No.49138 of 2017 and Cr. Misc. No.49270 of 2017 respectively. The petitioner is in custody since 31.07.2017 and he has got no criminal antecedent.
Having considered the said facts and circumstances, petitioner Ravi Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Patna in connection with Ram Krishna Nagar P.S. Case No.210 of 2017.
