====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 13-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Majorganj P.S. Case No. 248 of 2021 lodged under Sections 302 and 120B/34 of the Indian Penal Code read with Section 27 of the Arms Act.

The prosecution case is that informant alleged that his elder brother namely Ram Sagar Mahto has deceitfully got registration of 150 decimal of land from his mother in the name of her treatment, in which the share of all the brothers was there. Upon knowledge, all brothers and father started putting pressure upon him to return the land, it is due to this reason Ram Sagar Mahto alleged to hatched a conspiracy and killed his father with the help of unknown criminals, in this case 4 persons were

Learned counsel for the petitioner submits that name of the present petitioner has figured in this case by the informant only due to the reason, that she is wife of Ram Sagar Mahto, there is nothing available on record against her. He further submits that petitioner is in custody since 19.12.2021, charge sheet has already been filed and petitioner has no criminal antecedent. Learned counsel for the petitioner further submits that accused namely Ram Sagar Mahto has been granted anticipatory bail by the Co-ordinate Bench of this Court vide order dated 28.06.2022 passed in Cr. Misc. No. 25533 of 2022. Learned counsel for the State opposes the prayer for bail.

Learned counsel for the informant also appeared in this case and opposes the prayer for bail stating that Pan Devi is the main conspirator behind this occurrence and, therefore, her bail petition may be rejected and if not at least case diary may be called for.

Considering the facts and circumstances and submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to
