In this case, the petitioner is seeking anticipatory bail in connection with Darauli P.S. Case No. 278 of 2018, registered for the offence under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code.

A raid was conducted and it was found that Archna Seva Sadan is being run by unqualified doctors. Learned counsel for the petitioner submits that during the inquiry it has come that said Archana Seva Sadan is run by one Dr. S.K. Sahani and Jawahar Prasad and the present petitioner was there as an attendant of the patient. He further submits that the allegations have been made against Dr. S.K.

As there is no direct allegation against the present petitioner, let the petitioner, namely, Swasti Prasad, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, in connection with Darauli P.S. Case no. 278 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that whenever the police will call the petitioner for the purposes of investigation and interrogation, he will remain present for the investigation. In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled.
