The petitioner, apprehending his arrest in connection with Thakraha P.S. Case No. 69 of 2014 registered for the offence under Section 448 , 354, 504/34 of the Indian Penal Code has prayed for grant of anticipatory bail.
Learned counsel for the petitioner submits that during investigation it has come that the victim was mentally sick and he further submits that the allegation made in the F.I.R. was not thoroughly corroborated.
Besides hearing, I have also perused the materials available on record particularly the order of the learned Sessions Judge. Learned Sessions Judge has also noticed that mental condition of the informant's wife on whose disclosure F.I.R.
Patna High Court Cr.Misc. No.39044 of 2014 (2) dt.20-03-2015 2/2 was lodged was not fit.
In view of the facts and circumstances, in the event of arrest or surrender within a period of eight weeks from today, let the petitioner namely Raju Yadav be enlarged on bail on furnishing bail bond of Rs. 10000 /- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bagaha, West Champaran, in connection with Thakraha P.S. Case No. 69 of 2014 under conditions as contemplated under Section 438(2) of the Cr.P.C. (Rakesh Kumar, J) Praful/- U T
