The petitioner seeks bail in connection with Khagaria (Chitra Gupta Nagar) P.S. Case no. 514 of 2017 registered for the offence punishable under Section 392 of the Indian Penal Code.

Four motorcycles borne criminals are said to have been looted Rs. 3,29,300/- and mobile phone of the informant from the collection point of ITZ Cash.

It is submitted by the learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor any incriminating article has been recovered from his conscious physical possession. He and co-accused namely, Harsh Vardhan have been named on the basis of confessional statement of

Patna High Court Cr.Misc. No.53868 of 2017 (2) dt.09-11-2017 2/2 co-accused Abhimanyu Singh and barring his confessional statement, there is nothing in the case diary indicating complicity of the petitioner in the occurrence and the said Harsh Vardhan Kumar has been enlarged on bail by this Court vide order dated 18.10.2017 passed in Cr. Misc. no. 50381 of 2017. The petitioner has been languishing in custody since 07.08.2017. Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria in connection with Khagaria (Chitra Gupta Nagar) P.S. Case no. 514 of 2017.
