The petitioners apprehend arrest in Parsa Bazar P.S. Case No. 127 of 2016 instituted for the offence under Sections 302/34 of the IPC.

It has been submitted that petitioners are father-inlaw, mother-in-law and brother-in-law of the deceased. Learned counsel for the petitioners has submitted that none of the witnesses is an eye-witness. They have stated in the case diary that they heard that the victim lady died due to burn injuries. In the written report, it is alleged that informant got information on telephone that his daughter has been set on fire

Patna High Court Cr.Misc. No.63468 of 2017(3) dt.02-04-2018 2/2 in her sasural. Thereafter, when the informant went to her daughter's sasural, he saw that his daughter's dead body was lying in veranda. He also found household articles and clothes were burnt. The door was found opened and all the family members had absconded. All the witnesses have stated in the case diary that when they reached the place of occurrence they found all the accused persons were absconding and the deceased was lying dead on account of burn injury.

In such circumstances, this Court is not inclined to grant anticipatory bail to the petitioners.

Accordingly, this anticipatory bail petition stands rejected.

The petitioners are directed to surrender in the court below within six weeks from today and seek regular bail which will be considered by the court below in accordance with law, without being prejudiced by this order.
