JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-03-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Sidhwaliya P.S. Case No. 239 of 2018 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 13.02.2019. He further submits that in the instant case24.30 litres of foreign liquor was seized. He further submits that nothing was seized from the house of the petitioner or from his possession. He further submits that the name of the petitioner surfaced in the confessional statement of co-accused. Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/-

Patna High Court CR. MISC. No.17008 of 2019(2) dt.25-03-2019 2/2 (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Gopalganj in connection with Sidhwaliya P.S. Case No. 239 of 2018.
