2. Learned counsel appearing on behalf of the petitioner has very fairly submitted that it cannot be said, based on allegation made in the FIR, that no offence is made out based on the said allegations. He has, however, submitted that the petitioner has been falsely implicated for extraneous reasons.

3. In the facts and circumstances of the case, this application is disposed of with a liberty to the petitioner to raise the grounds, which he has raised in the present application, before the court below at the time of framing of charge or any subsequent stage of the trial.
