Heard the learned counsel for the petitioner and Mr. Ajay Mishra, learned APP for the State.
The petitioner apprehends his arrest for the offences alleged under Sections 467, 468, 471, 120(B) and 420 of the Indian Penal Code, registered in connection with Dighlbank P.S.Case No. 01 of 2022.
As per allegation, the petitioner became successful in securing the job of Panchayat Teacher after producing forged matriculation certificate. His matriculation certificate was sent for verification to the Bihar School Examination Board and on verification it was found forged.
The learned counsel for the petitioner has submitted that he has resigned from his service. He has further submitted that the petitioner is ready to deposit 50% of the salary received during his tenure as Panchayat Teacher.
Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of
Patna High Court CR. MISC. No.18579 of 2022(2) dt.08-08-2022 2/2 this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Dighalbank P.S.Case No. 01 of 2022, subject to the conditions as laid down under Section 438(2) Cr. P.C. with further condition that the petitioner shall deposit 50% of the salary he has drawn during his tenure as Panchayat Teacher, within six months from this order and only after that the court below shall confirm his bail bond.
Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
