Heard Mr. Rajkishore Prasad for the petitioner and Mr. Ram Priya Sharan Singh, learned counsel for the State. The petitioner seeks bail in connection with Kotwali (Basudeopur) P.S. Case No. 527 of 2018 dated 10.12.2018 instituted for the offence under Sections 366/34 of the Indian Penal Code.

It has been alleged in the First Information Report that the minor daughter of the informant has been kidnapped by Gulshan

Kumar, Lalan Yadav and Rubi Devi for the purposes of marrying her.

Learned counsel for the petitioner has stated that the petitioner has not been named in the First Information Report and his name has transpired during the course of investigation in the confession of aforesaid three named accused persons. It has further been argued that the First Information Report was lodged after two days of the occurrence and the victim girl in her statement under Section 164 Cr.P.C., though has named the petitioner as having come to her along with another for taking her to a distant place and has also stated about ill treatment to her during the period of captivity but has not stated anything about any sexual attack against her.

The petitioner is stated to be in custody since 24.12.2019 and this Court has been informed that one of the named accused persons, namely, Lalan Yadav has been granted anticipatory bail by a Bench of this Court.

Considering the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on

furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Kotwali (Basudeopur) P.S. Case No. 527 of 2018.
