JUSTICE MADHURESH PRASAD ORAL ORDER 19-02-2018 Heard counsel for the petitioner and APP for the State. Petitioner, who is husband of the deceased, is an accused in a case registered for offence under sections 304B and 34 IPC.

Counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to misunderstanding which is evident from the compromise petition filed in the court below which is Annexure 2. He points out that in paragraph 50 of the case diary it has come that in course of investigation motherin-law of the deceased tried to extinguish the fire in course of which she received injuries. He submits that the victim caught fire while cooking food. Petitioner has no antecedent and he is in custody since 22.8.2017.

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named

Patna High Court Cr.Misc. No.63358 of 2017 (3) dt.19-02-2018 2/2 be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in Basantpur Police Station Case No. 162 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner.

(b) He/she will be well represented on each date and if he/she fails to do so on two consecutive dates, his/her bail will be liable to be cancelled.
