The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 427 and 436 of the Indian Penal Code.

The prosecution case as per the written report of Sayed Nazir Jamal submitted to SHO, Phulwarisharif Police Station is to the effect that on 03.12.2017, the manager of the informant informed him that 1000 of persons variously armed have arrived at his poultry farm and have set it on fire. Thereafter, he informed the police and on 04.12.2017, when he went to the poultry farm, he found 1000 chicks missing and his poultry farm was totally burnt, leading to the registration of FIR against unknown persons.

A statement has been in paragraph 3 of the petition that petitioner is involved in five other cases out of which, he is on bail in four cases. It is submitted by learned APP for the State that the petitioner has criminal antecedent.

Considering the general and omnibus accusation against the mob, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Patna in connection with Phulwarisharif P.S. Case No. 781 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
