The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.

The prosecution case is that the petitioner being the Halka Karamchari of Paliganj Block did not deposit the revenue amount collected by him in the financial year 201314. It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.6265 of 2016 (2) dt.09-02-2016 2/3 petitioner that the exact amount has not been mentioned in the FIR and the petitioner claims to have deposited the amount in question.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail provisionally for four months, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur in connection with Paliganj P.S. Case No. 122 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

It is expected from the Circle Officer, Paliganj to supply the detail of exact amount collected by the petitioner and the detail of amount not deposited and if the petitioner deposits the due amount within one month of receipt of the detail of non-deposited amount then the provisional bail will be confirmed by the learned court below, but if the petitioner fails to deposit the amount then the petitioner will surrender and pray for regular bail.
