JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-01-2018 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek regular bail in connection with Govindpur P.S. Case No. 76 of 2017 instituted for the offences under Section 30(a) of the Bihar Excise Prohibition Amendment Act, 2016.

The allegation against the petitioners is regarding manufacturing and selling illegal wine. It is submitted that the coaccused person was arrested from the spot and 45 litres of Mahua wine was recovered apart from recovery of Mahua flower. The learned counsel for the petitioners submits that no recovery has been made from the possession of the petitioners. The petitioners have a clean antecedent and they are in custody

Considering the nature of accusation, the period of custody already undergone and the fact that the petitioners are having a clean antecedent, I deem it fit and proper to enlarge the petitioners above named on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Session Judge-II, Nawada in connection with Govindpur P.S. Case No. 76 of 2017.
