JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-03-2019 The petitioner, who is a seventy five years old P.D.S. dealer, seeks bail in anticipation of his arrest in connection with Alauli P.S. Case No. 443 of 2018, dated 24.12.2018, instituted for the offences under Section 7 of the Essential Commodities Act, 1956.
Six bags of rice were found to have been kept on the trolley, which rice was found to be of State Food Corporation. The aforesaid information was provided by one
Patna High Court CR. MISC. No.17836 of 2019(2) dt.29-03-2019 2/2 Shyam Sunder to the informant in collusion with the Pramukh of Alauli Block. When the godown of the petitioner was raided, some amount of rice was found to be short. Considering the nature of accusation against the petitioner, which is mainly on the basis of information provided by somebody else who has definite animus against the petitioner, the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Khagaria, in connection with Alauli P.S. Case No. 443 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
