JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-05-2023 Heard learned counsel for the petitioners and the State. Petitioners apprehend arrest in a case registered for the offence punishable under Sections 272, 273, 34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition Excise Act, 2016.

Prosecution case is that 495 litres of Nepali country made liquor was recovered form a scorpio.

Learned counsel appearing for the petitioners submits that recovery has been made from the scorpio, nothing has been recovered from the conscious possession of the petitioners. Petitioners are neither the owner nor the driver of the vehicle. The names of the petitioners have transpired merely on suspicion.

Learned counsel for the State opposed the prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Jhanjharpur, Madhubani in connection with Laukahi (Narahiya O.P.) Police Station Case No. 277 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
