The petitioners are apprehending their arrest in a case registered under sections 20, 22 and 24 of the N.D.P.S. Act.

Learned counsel for the petitioners submits that the allegation against the petitioner is made on the basis of possession of land where the ganja plant said to have been found and it was under the cultivation and possession of these petitioners. Learned counsel further submits that owner of the land where the aforesaid ganja plant was said to have been grown was not made accused in this case. He further submits that in any view of the matter the proportionate amount found is only 15 kg

Patna High Court Cr.Misc. No.30371 of 2015 (3) dt.29-10-2015 2/2 which come under (smaller quantity) as defined in the act. Considering the aforesaid facts and circumstances and the nature of allegation made against the petitioners, let the above named petitioners in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Sessions Judge, Nawada in Special Case No. 01/2015 arising out of Nardiganj P.S. Case No. 09 of 2015, subject to the conditions as laid down under section 438(2) Cr.P.C.
