1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Banka P.S. Case no. 568 of 2023 registered under sections 379, 411 and 414 of the Indian Penal Code.

3. As per the prosecution case, while the informant had parked his vehicle and went to the market for some work, on return he found his vehicle to have been stolen.

4. The case of the petitioner as is evident from the contents of the petition is that the F.I.R was registered against unknown. One another F.I.R being Dhankund P.S. Case no. 121 of 2023 was registered on the said motorcycle of the informant of the instant case having been recovered. The petitioner was remanded in the instant case from that case. The petitioner is in custody since 31.10.2023, has not been put on T.I parade and

Patna High Court CR. MISC. No.20583 of 2024(2) dt.02-04-2024 2/2 charge-sheet has been submitted in the case.

5. The application for bail is opposed by learned APP for the State.

6. Having gone through the contents of the petition and having heard learned APP for the State, taking into consideration the allegations in the F.I.R, the material that has transpired in course of investigation as is evident from the order of the learned trial Court, another F.I.R having been registered with respect to the recovery of the stolen motorcycle, the petitioner having been remanded in this case from the said case and the petitioner having remained in custody for more than 4 months since 31.10.2023, the petitioner is directed to be enlarged on bail in connection with Banka P.S. Case no. 568 of 2023, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka.
