18-08-2018 Heard Sri Bimlesh Kumar Pandey, learned counsel for the petitioner and Sri Ram Bachan Singh, learned Addl. Public Prosecutor.

The petitioner, husband of the deceased, has prayed for grant of bail in Semera P.S. Case No. 33 of 2018 registered for offence under Sections 302, 304B, 201/34 of the Indian Penal Code.

Learned counsel for the petitioner tried to persuade the Court that it appears that the daughter of the informant fled away and thereafter, a false case has been instituted. However, fact remains that in the F.I.R. itself, it has been alleged that marriage of daughter of the informant, which was solemnised with the petitioner, only three years back and the petitioner alongwith other family members had tortured the

Patna High Court Cr.Misc. No.49163 of 2018(2) dt.18-08-2018 2/2 victim, demanding dowry and thereafter, it was alleged that the informant got information that his daughter was done to death. While the informant reached the matrimonial house of his daughter, he saw that all the accused persons had already fled away.

Considering the fact that marriage of the petitioner with deceased was solemnized within three years, she went missing from the house of the petitioner itself and there is also allegation of torture due to non-fulfillment of demand of dowry, there is no reason to pass favourable order.

The prayer for bail stands dismissed.
