This is an application for bail in connection with Nawada Nagar P.S.Case No. 648 of 2016 registered for the offences punishable under Sections 341, 323, 379 and 420/34 of the Indian Penal Code.
Allegation as per FIR is that in spite of executing agreement co-accused Rajo Yadav has not executed sale deed and he has received consideration money also and allegation against the petitioner is that he assaulted the informant with fists and slaps.
Submission of learned counsel for the petitioner is that at the main accused Rajo Yadav has been granted anticipatory bail by a co-ordinate Bench of this Court in Cr.Misc.No.15807 of
Patna High Court Cr.Misc. No.55892 of 2017 (2) dt.22-11-2017 2/2 2017, vide order dated 3.5.2017 and he is in custody since 16.8.2017.

Having heard both sides and considering the facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Nawada Nagar P.S.Case No. 648 of 2016, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (2) Petitioner will co-operate in trial and appear on each and every date in court, except showing any genuine reason, failing which his bail bond shall be cancelled.
