11-01-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
Petitioner, in the present case, is seeking regular bail in connection with Goraul P.S. Case No. 185 of 2017 registered for the offence punishable under Sections 25(1-b)a/26/35 of the Arms Act and 414 of the Indian Penal Code.
Learned counsel for the petitioner submits that two live cartridges were recovered from the possession of this petitioner at the time of his arrest. The petitioner is said to be in custody since 07.08.2017. Learned counsel further submits that in the two cases mentioned in paragraph-3 of the application, the petitioner is on bail.
Learned Additional Public Prosecutor for the
Patna High Court Cr.Misc. No.107 of 2018 (2) dt.11-01-2018 Sate opposes the prayer for bail of the petitioner. Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Hazipur at Vaishali, in connection with Goraul P.S. Case No. 185 of 2017 ̧ subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure, and further petitioner shall file the order by which he has been granted bail in another two cases.
