Petitioner seeks bail in Sabaur P.S. Case No.359 of 2018 registered under Sections 147, 148, 341, 323, 324, 325, 307 of the I.P.C. Later on Section 302 of the I.P.C. was added. The informant disclosed that when he at about 2:00 in the night of 22.12.2018 came out for urination, the villagers Ranjeet Yadav (petitioner), Masudan Yadav, Ram Yadav, Basdi Yadav, Rasiklal Yadav came there. Ranjeet Yadav dragged him inside the house and closed the door from inside. All accused persons indiscriminately assaulted him with stick and presuming him to be dead threw his body in the back side of the house. The informant was brought to Hospital and he was admitted, but it appears that later on during course of his treatment, the informant died.

No.16427 of 2020(5) dt.28-09-2020 2/3 Learned counsel for the petitioner submits that the petitioner along with four other accused persons is named in the F.I.R. and all the five accused persons are alleged to have indiscriminately assaulted the informant but later on the informant died during course of treatment. The other accused persons, namely, Madhusudan Yadav in Cr.Misc.No.20218 of 2020, Basdi Yadav in Cr.Misc.No.25118 of 2020, Ram Yadav in Cr.Misc.No.35385 of 2019 have already been granted regular bail by different benches of this court. The case of the petitioner stands on the same footing. The petitioner is in jail since 13.10.2019.

Learned A.P.P. did not dispute the facts.

Taking into consideration the facts that the petitioner along with other accused persons are alleged to have indiscriminately assaulted the informant after dragging him inside the house and the informant died during course of treatment but similarly situated accused persons, namely, Madhusudan Yadav, Basdi Yadav and Ram Yadav have already been granted bail and the case of the petitioner stands on the same footing, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the
