The petitioner is apprehending his arrest in a case registered for the offences punishable under sections 147, 148, 149, 323, 504, 379 of the Indian Penal Code and Section 3(1)(x) of the SC/ST (POA) Act.

The prosecution case is that co-accused Kashi Pd. Kesari and and Babita abused the informant by calling caste name. It is further alleged that on the order of the petitioner Lalbabu Keshri and Asthami Keshri assaulted the informant. It is submitted by the learned counsel for the petitioner that an earlier point of time the petitioner had lodged a case against the informant being Kudra P.S. Case No. 19 of 2014

Patna High Court Cr.Misc. No.33711 of 2015 (2) dt.13-08-2015 2/2 and a statement to this effect has been made in paragraph 7 of the petition and the present case has been lodged in retaliation of the case filed by the petitioner's side.

Considering the aforementined facts, the above named petitioner in the event of his arrest or surrender before the court below within a period of twelve weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in Kudra P.S. Case no. 259 of 2014, subject top the conditions laid down under section 438(2) Cr.P.C.
