The petitioner seeks regular bail in connection with Nawanagar (Sonbersa) P.S. Case No. 198 of 2018 for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of huge quantity of illicit liquor from the field of a co-accused person, namely, Surendra Singh.

The learned counsel for the petitioner submits that neither any recovery has been made from the conscious possession of the petitioner nor from his house and he has been falsely implicated in the present case and, in fact, the main

It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 14.02.2019. Lastly, it is submitted that similarly situated other accused persons have already been granted bail by this Court and a coordinate Bench of this Court vide orders dated 12.03.2019 and 15.3.2019 passed in Cr. Misc. No.14898 of 2019 and Cr. Misc. No. 16255 of 2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional District Judge-Iind-cum- Special Judge, Excise Act, Buxar in connection with Nawanagar (Sonbersa) P.S. Case No. 198 of 2018.
