JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Sidhwalia P.S. Case No. 26 of 2020, registered under Section 414 of the Indian Penal Code and Section 30(a) of the Bihar Excise Act.

The accusation is that in course of patrolling duty, informant and other police personnel came to know that accused of Sidhwalia P.S. Case No. 118 of 2019, who is on bail, is carrying the liquor loading on motorcycle from village Salempur to village Saraya Pahar, then informant and other police personnel reached at village Saraya Pahar near Kabristan and saw two persons sitting on motorcycle. No.19207 of 2020(2) dt.05-06-2020 2/2 party, they started to flee away, but on chased, both persons were apprehended, who disclosed their names as Jai Narayan Sah and Baliram Prasad (petitioner). On search, two plastic gallon, each containing 20 litres country made liquor were recovered from the said motorcycle.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 07.02.2020.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise, Gopalganj, in connection with Sidhwalia P.S. Case No. 26 of 2020. Out of two sureties, one surety must be the close relative of the petitioner.
