The petitioner is husband of the complainant and apprehends his arrest in connection with Complaint Case No. 2263(C)/2012. It is submitted that marriage between the complainant and the petitioner was solemnized in the year 1992. Nearly 20 years thereafter, the present complaint has been lodged with allegation that she was tortured on account of non-fulfilment of dowry. Prior to this, the petitioner has also lodged a case against the complainant. He further submits that if the complainant is ready and willing to live with him, he is ready to give her due honour and protection as his wife.
Patna High Court Cr.Misc. No.39057 of 2014 (2) dt.13-03-2015 Regard being had to above, this Court directs that in the event of arrest or surrender within four weeks in the Court below, the petitioner abovenamed be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Patna in connection with Complaint Case No. 2263(C)/2012 subject to the condition as laid down under Section 438(2) of the Cr.P.C. with further following conditions:
(i) One of the bailors shall be own/close family member of the petitioner.
(ii) Along with the bail bonds, the petitioner shall produce receipt showing payment of a sum of Rs. 6,000/- to the complainant and/or furnish a demand draft favouring the complainant. The complainant shall be entitled to receive the same.
