Nobody appears for Nagar Parishad, Madhubani. Learned counsel for the petitioner submits that the petitioner has retired on 31.01.2019 from the post of Upper Division Clerk, but nothing has been paid to the petitioner towards the post retiral benefits. Learned counsel next submits that similar matter has been disposed of by this Court in a writ application filed by the retired employee of Madhubani Nagar Parishad passed in CWJC No. 5962 of 2020 dated 24.7.2021 wherein this Court has directed the petitioner to file a detailed representation before Respondent No. 3 within a period of two

Patna High Court CWJC No.5775 of 2020(3) dt.05-08-2021 2/2 weeks' from the date of order. Learned counsel further submits that the case of the petitioner is similar in nature and the same is squarely covered by the order passed by this Court in CWJC No. 5962 of 2020.

In view of the submission made above, this writ application is disposed of exactly in the same terms of the order dated 24.7.2021 passed by this Court in CWJC No. 5962 of 2020 with a direction to the petitioner to file a detailed representation before Respondent No.3 within a period of two weeks' from today.

Needless to say that if such representation is filed by the petitioner, the same shall be disposed of in accordance with law by a reasoned order within a further period of two months from the date of filing of representation and if any admissible amount is found payable to the petitioner, the same shall be paid by the respondents within one month from the date of disposal of the representation.
