The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 341, 342, 323, 353, 427 and 504 of the Indian Penal Code. It is alleged that 100 to 150 persons assaulted two persons treating them as extremists by blocking the road. When the Police came there, the Police Personnel were abused. The accusation is omnibus and general in nature.
Learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.31512 of 2015 (2) dt.03-08-2015 2/2 petitioners have no criminal antecedent. Similarly situated coaccused Tuntun Singh @ Tuntun Kumar and others have been granted anticipatory bail in Criminal Miscellaneous No. 14204 of 2015.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Alamnagar P.S. Case No. 61 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
