The petitioner, in the present case, is seeking regular bail in connection with Sheohar P.S. Case No.28 of 2018, registered for offences alleged under Sections 304(B) and 120(B) of the Indian Penal Code.
Learned counsel for the petitioner submits that this petitioner is the father-in-law of the deceased. He has been falsely implicated being a member of the family. However, this petitioner was living separately and had no connection with the family of the deceased. It is further submitted that the similarly situated persons who are mother-in-law and elder brother-in-law of the deceased
Patna High Court Cr.Misc. No.51793 of 2018 (2) dt.20-09-2018 have been granted privilege of anticipatory bail by a learned coordinate Bench of this Court in Cr.Misc.No.31700 of 2018 vide order dated 24.07.2018.
Learned APP for the State is present and has opposed the prayer for bail.
Considering the facts and circumstances of the case where the petitioner is father-in-law and the mother-in-law as well as elder brother-in-law have been granted privilege of anticipatory bail by a learned co-ordinate Bench of this Court, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheohar in connection with Sheohar P.S. Case No. 28 of 2018, subject to the conditions U/S 437(3) Cr.P.C. (Rajeev Ranjan Prasad, J) Arvind/- U T
