Let the defect(s) be removed within four weeks of the complete start of the physical Court in normal course. The petitioner is in judicial custody in connection with Dhoraiya P.S. Case No.61/2020 instituted under Sections 467,468,471,420,120(B) of the Indian Penal Code. The allegation in the FIR is that the petitioner who was collecting agent for the meter reading and electricity bills failed to deposit the collected amount of altogether Rs.29,000/-. As he failed to deposit the collected amount, the FIR was lodged. Subsequently as per the counsel for the petitioner the amount has been deposited. Taking into account the statement made by the learned counsel for the petitioner that the said amount has been deposited, the petitioner is in custody since 25.01.2022 (as stated in para-7 of the bail application) and has no criminal antecedent, this Court is

Patna High Court CR. MISC. No.18715 of 2022(2) dt.28-07-2022 2/2 inclined to grant him privilege of bail.

Let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each in connection with Dhoraiya P.S. Case No.61/2020 to the satisfaction of learned Chief Judicial Magistrate, Banka, subject to following conditions:

(i) one of the bailor should be the family member of the petitioner, who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial court and failure to do so for two consecutive dates without plausible reasons will entail cancellation of his bail by the Trial court itself;

With the aforesaid observations, the bail application is allowed.
