The petitioner apprehends his arrest in a case under sections 364 and 511 of the I.P.C.

The informant made allegation that the petitioner along with other unknown persons tried to kidnap the grand daughter of the informant but when many family members came at the spot, the petitioner tried to flee away, he fell down from the motorcycle. Learned counsel for the petitioner submits that on the same day, the petitioner lodged a case bearing Gopalganj Town P.S.Case No.140 of 2011 under section 307 IPC. The police, after investigation, found the allegation false against the petitioner but the learned Chief Judicial Magistrate, took cognizance against him.

Considering the facts that the police, after investigation, found the case to be false and the learned Magistrate took cognizance, petitioner, named above, in the event of his arrest/surrender before the court below within four weeks from

Patna High Court Cr.Misc. No.40400 of 2014 (2) dt.25-03-2015 the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Jitendra Kumar, Judicial Magistrate, Ist Class, Gopalganj in connection with Complaint Case No.C-487/2012 arising out of Gopalganj P.S.Case No.141 of 2011 (Trial No.2341 of 2013), subject to condition laid down u/s 438(2) Cr.P.C.
