The petitioners apprehend their arrest in registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.
The informant alleged that the petitioners and Kedar Chauhan asked her husband to execute the Bajidawa. Her husband told that he got decree in his favour, on such Kedar Chauhan assaulted him with Pharsa on his head and others assaulted him with Lathi. Vinod Chauhan the father-in-law of the informant came to save, Kishori Chauhan and and Binod Chauhan petitioner nos. 3 and 4 assaulted him with Lathi causing fracture injury on his leg.
Patna High Court Cr.Misc. No.33129 of 2015 (4) dt.05-11-2015 2/2 It is submitted that no such occurrence took place. There is a land dispute between the parties. The injury report is incorporated in para 28 and 29 of the case diary, it would appear that the injuries found on the person of Rajo Chauhan and Bihari Chauhan are superficial and simple in nature. Learned APP did not dispute the facts.
Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in Nawada Town (Kadirganj) P.S. Case No. 249 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
