JUSTICE ARUN KUMAR ORAL ORDER 17-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Bettiah Town PS Case No. 389 of 2017 registered under Sections 20, 22, 23, 24, 27A and 29 of the NDPS Act.

The allegation in brief is that four persons were going on a motorcycle, the police stopped them and searched the vehicle, recovered 200 grams of Charas kept under the seat of the motorcycle.

Learned Counsel for the petitioner submits that out of four, three co-accused namely Munna, Samrat and Ritesh have been admitted to bail by a coordinate Bench of this Court and the petitioner has no antecedent.

However, learned Counsel for the State submits that the motorcycle was also found to be stolen one.

Having considered the said facts and circumstances, the petitioner, namely, Guddu Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of lst Additional Sessions Judge -cum- Special Judge Bettiah, West Champaran in connection with Bettiah Town PS Case No. 389 of 2017.
