The sole petitioner, who is in custody since 21.04.2018 in Ismailpur P.S. Case No.12 of 2018 registered for the offence under Sections 20,22 and 25 of the Narcotic Drugs and Psychotropic Substances Act,1985 , has prayed for grant of bail.
Learned counsel for the petitioner submits that the petitioner has falsely been made accused on an accusation of recovery of 2 Kg of Ganja. He submits that seizure was itself contrary to the statutory provision. He reiterates that recovered Ganja was not of commercial quantity and the petitioner is having clean antecedent, which fact has been stated in
Patna High Court Cr.Misc. No.48872 of 2018(2) dt.18-08-2018 2/2 paragraph-3 of the petition.
Considering the nature of accusation, period of custody as well as clean antecedent of the petitioner, let the petitioner, namely, Shankar Singh be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Bhagalpur in connection with Ismailpur P.S. Case No.12 of 2018.
