JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-06-2019 This is an application for grant of anticipatory bail in connection with Pusa P. S. Case No. 94 of 2018, disclosing offences under Sections 147, 148, 149, 307, 323, 325, 341, 342, 504 and 506 of the Indian Penal Code.
Allegation as per F.I.R. is that petitioner no.1 assaulted the informant by rod and thereafter, all the petitioners have assaulted the informant, causing injury and further allegation is that petitioner no.2 has dragged the informant to his house.
Submission of the learned counsel for the petitioners is that the whole allegation are false and concocted and further

Heard learned A.P.P. also who has opposed the prayer for bail and submitted that opinion was kept reserved and CT Scan clearly shows that they have assaulted the informant, causing injury on his person and also dragged him to his house by the accused persons including the petitioners. Having heard both sides, in view of the facts and circumstances, as stated above, so far as, petitioners no.1 & 2 are concerned, I am not inclined to grant privilege of anticipatory bail to the petitioners no.1 & 2, however, they are directed to surrender before the learned court below and make prayer for regular bail, which shall be considered by the learned trial court, if possible to be disposed of on the same day. However, so far as, petitioner no.
3 is concerned, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Samastipur, in connection with Pusa P.S. Case No. 94 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
