Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners apprehend their arrest in Wazirganj P.S. Case No. 174 of 2019, registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.
Prosecution case in brief is that informant's daughter was married with one Sanjay Prasad @ Loha, two daughters were born from the said wedlock, thereafter Sanjay Prasad @ Loha died. Thereafter, all the accused persons including these
Patna High Court CR. MISC. No.15996 of 2020(3) dt.02-09-2020 2/2 petitioners began to torture the daughter of informant, as they wanted to grab the land of informant's daughter. On 29.05.2019, the informant received information that his daughter was done to death and her dead-body was found in Nala of the village Rampur and Marhi.
It is submitted that petitioners have been falsely implicated in this case on the basis of suspicion. There is general and omnibus allegation. Petitioner no. 2 is married Nanad of the deceased and petitioner no. 1 Nandosi. Petitioners are living separately and they have no concern with the family affairs of the deceased.
Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Gaya in connection with Wazirganj P.S. Case No. 174 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
