JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 14-09-2017 The present petition has been filed for transfer of Matrimonial Case No. 54 of 2014 from the Court of learned Principal Judge, Family Court, Begusarai to the Court of learned Principal Judge, Family Court, Patna.
2. The short facts according to the petitioner are that the parties were married on 23.11.2010 and some time thereafter a son was born with a defect in his heart. Following cruelty and torture meted out to the petitioner, she left her matrimonial house and is presently residing with her parents at Patna.
3. Learned counsel for the petitioner submits that petitioner being a lady with a young son having a heart problem, it
Patna High Court MJC No.3463 of 2014 dt.14-09-2017 would be very difficult for her to attend the matrimonial case at Begusarai.
4. Learned counsel Mr. Rana Ishwar Chandra appearing on behalf of the opposite party states that there is no objection to the transfer of the subject matrimonial case as sought by the petitioner.
5. In the above view of the matter, let the Matrimonial Case No. 54 of 2014 be transferred from the court of learned Principal Judge, Family Court, Begusarai to the Court of learned Principal Judge, Family Court, Patna.
6. The petition stands allowed.
