The petitioner is apprehending arrest in a case registered for the offences punishable under sections 364A and 395 of the Indian Penal Code.
The accusation is of abducting, robbing cash, Nokia mobile and demanding extortion of rupees ten thousand from the informant. The FIR was lodged against unknown. Name of the petitioner subsequently sprang up during investigation. During investigation co accused Dinesh yadav disclosed the name of the petitioner and Ajay yadav from whose house rifle was recovered which alleged to have been kept by this petitioner and Ajay Yadav.
Patna High Court Cr.Misc. No.30692 of 2015 (2) dt.30-07-2015 2/2 It is submitted by the learned counsel for the petitioner that never any process was executed against the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Since the case was instituted in 2009, this court is not inclined to grant anticipatory bail to the petitioner. However, the aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Laxmipur P.S. Case No. 156 of 2009 pending in the court of learned SDJM, Jamui.
This application is disposed of with the aforesaid observation/direction.
