1. Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the informant.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109(1), 352, 351(2) and 3(5) of the BNS.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that her son Vinod Sah, Rahul Sah (petitioner) and Geeta Devi, wife of Vinod Sah came on 23.11.2025, at 03:30 p.m., with an intent to grab her property and assaulted her and when her daughter Namita Devi, Nandini Kumari along with daughter-in-law Kunti Devi came to save her, Vinod Sah

Patna High Court CR. MISC. No.17692 of 2026(4) dt.21-07-2026 2/3 assaulted Namita Devi by sword causing injury on her forehead while petitioner assaulted Kunti Devi by knife causing injury on hand. Further, Nandini Devi also got injured and the informant suffered fracture of hand when villagers gathered, the accused persons fled away and the injured were taken to the hospital.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant on account of dispute relating to land. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that petitioner is alleged to have assaulted Kunti Devi by knife causing injury on her hand but then from perusal of the injury report, it would manifest that the wound is lacerated caused by hard and blunt substance and has been opined to be simple in nature

5. Learned A.P.P. for the State and learned counsel appearing on behalf of the informant opposed the prayer for anticipatory bail of the petitioner.

6. Learned counsel appearing on behalf of the informant submits that informant of the instant case is mother of Vinod Sah and the petitioner. It is further submitted that her sons along with Geeta Devi came to her house and assaulted her and her daughters. It is next submitted that the injury suffered by the

It is also submitted that one can well imagine the plight of a mother how she must have felt while instituting the instant FIR against her sons who in greed of property did not even think twice before assaulting their own sister and mother.

7. After hearing the learned counsel for the parties, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner in connection with Kuchaykot P.S. Case No. 517 of 2025 pending in the Court of learned Chief Judicial Magistrate, Gopalganj/Successor Court.
