JUSTICE ARUN KUMAR ORAL ORDER 17-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Patory PS Case No. 211 of 2017 registered under Section 304B/34 of the IPC. The allegation in brief is that the petitioner's wife was killed by him and other family members when demand of dowry was not realized and the marriage was solemnised five years back. Learned Counsel for the petitioner submits that at the relevant point of time the petitioner was in Surat and his wife died of illness, post mortem was also held and opinion was reserved for FSL report but no poison was detected in the viscera and the petitioner is in custody since 11.9.2017.

Having considered the said facts and circumstances, the petitioner, namely, Sanjay Kumar Rai is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Samastipur in connection with Patory PS Case No. 211 of 2017.
