The petitioner seeks bail in connection with Arwal P.S. Case No. 155 of 2017 dated 12.08.2017 instituted for the offence under Section 414 of the Indian Penal Code. On secret information that stolen motorcycles are kept in the house of Shamshad Khan, a raid was conducted and the stolen motorcycle was recovered. It was learnt that Dharmendra Kumar had given him the aforesaid motorcycle for the purposes of selling. In the same transaction, from the possession of the petitioner, one stolen motorcycle was recovered. Learned counsel for the petitioner has submitted that though the stolen motorcycle has been recovered from his possession but he had no idea that the motorcycle was a stolen

Patna High Court Cr.Misc. No.57252 of 2017 (2) dt.05-12-2017 one. In fact, he had purchased it without knowing the fact that it was a stolen property.

The petitioner is in custody since 13.08.2017. Taking into account the fact that the petitioner is in custody since 13.08.2017 and does not bear any criminal antecedent, this Court is inclined to grant bail to him. In the facts and circumstances, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in connection with Arwal P.S. Case No. 155 of 2017.
