JUSTICE JYOTI SARAN ORAL ORDER 27-03-2015 Heard Mr. Brij Nandan Prasad, learned counsel appearing on behalf of the petitioner and Mr. Shyam Bihari Singh, learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection Bounsi P.S. Case No.72 of 2014 registered for the offences punishable under sections 366(A), 504 and 506/34 of the Indian Penal Code.

The allegation against the petitioner is of abducting the minor daughter of the informant.

Learned counsel for the petitioner with reference to the statement of the victim girl present at Annexure-2 to this application submits that the girl claims to be a student of ClassIX aged 19 years old and has clearly stated that she had gone with the petitioner on her own volition.

No.37805 of 2014 (2) dt.27-03-2015 Having heard learned counsel for the parties and taking note of the circumstances existing, let the petitioner, namely, Rupesh Kumar Das in the event of his arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Bounsi P.S. Case No.72 of 2014; subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Jyoti Saran, J) SKPathak/- U T
