JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-11-2017 This application has been filed seeking direction to the Bihar School Examination Board, Bihar to grant affiliation to the petitioner Wahab Senior Secondary School, Bettiah for the session 2016-2018.

It is the case of the petitioner that the petitioner's application for grant of affiliation is pending with the Bihar School Examination Board since 2016.

Learned counsel, appearing on behalf of the petitioner, has submitted that the school fulfills the requisite conditions for grant of affiliation and the Court considering all these aspects ought to have taken decision on the question of grant of affiliation.

Considering the facts and circumstances of the case, I dispose of the writ application with direction to respondent no. 3

Patna High Court CWJC No.18674 of 2016 (2) dt.23-11-2017 2/2 to consider the petitioner's case for grant of affiliation and take a final decision within two months from the date of receipt/production of a copy of this order, in accordance with law. It is true that the application for affiliation was made for the session 2016-2018 which session commenced long back. However, if there is no bar under the regulations, the petitioner's case for grant of affiliation shall be considered by the Board for the subsequent sessions.

If the Board is of the view that the same application cannot be processed for subsequent sessions, it shall communicate the same to the petitioner forthwith.
