JUSTICE RAKESH KUMAR ORAL ORDER 17-11-2017 Heard Sri Nityanand Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Phulwarisharif P.S. Case No. 730 of 2016 registered for offence under Sections 399, 402 of the Indian Penal Code, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that petitioner has sufficiently remained in custody. The petitioner is in custody since 01-12-2016. He further submits that some of the accused persons have already been granted bail and as such, petitioner may be granted same privilege. Sri Damodar Prasad Tiwary, learned Addl. Public Prosecutor has drawn my attention to statement made in paragraph - 3 of the petition and submits that petitioner is accused in number of cases mostly relating to offence under

Patna High Court Cr.Misc. No.55450 of 2017(2) dt.17-11-2017 2/2 Section 395 of the Indian Penal Code and he submits that in case of an accused, having such criminal antecedent, the accused may not be extended the privilege of bail. The Court is in agreement with the submission of learned Addl. Public Prosecutor.
